Terms of sale

Article 1 – Seller identity and purpose The site revpartsworks.com ("the Site") is operated by Louis Duchêne, sole trader (micro-enterprise) trading as RevPartsWorks, 8 Impasse des Bolets, 53210 Argentré, France – SIRET 10676088700013 – registered with the Companies Register of Laval – email: revpartsworks@gmail.com ("the Seller"). These Terms of Sale apply to every sale concluded through the Site with any buyer ("the Customer"). The Customer confirms having read these Terms before placing an order; acceptance is evidenced by confirming the order. The applicable Terms are those in force on the date of the order.

Article 2 – Products and availability The products offered are those shown on the Site on the day of consultation, while stocks last. The essential characteristics of each product are set out on its page. Photographs are as faithful as possible but are not contractually binding. Some products are made to order by 3D printing and/or by hand: slight variations in appearance (shade, surface finish, layer lines, dimensional tolerances) are inherent to the process and do not constitute a defect of conformity. It is for the Customer to check that the product is compatible with their vehicle or intended use before ordering; in case of doubt, the Customer may contact the Seller.

Article 3 – Prices Prices are shown in euros, all taxes included. As the Seller benefits from the French VAT exemption scheme for small businesses, the following applies: "VAT not applicable, Article 293 B of the French General Tax Code" — no VAT is charged and none is recoverable. Prices exclude delivery charges, which are calculated according to destination and shown before the order is confirmed. The Seller may change prices at any time; the product is invoiced at the price in force when the order is placed.

Article 4 – Orders and formation of the contract The Customer selects the products, checks the summary and the total amount, enters their delivery and payment details, then confirms using a button marked "order with obligation to pay". This confirmation forms the contract. A confirmation email summarising the order is sent to the Customer and constitutes the record of the transaction. The Seller reserves the right to refuse or cancel an order in the event of a previous payment dispute, an abnormal order, or suspected fraud.

Article 5 – Payment and security Payment is due when the order is placed, by bank card through Shopify Payments or via PayPal. Payment data is handled securely by those providers; the Seller has no access to card numbers. The order is final only once payment has been accepted. The goods remain the property of the Seller until the price has been paid in full (retention of title).

Article 6 – Delivery, lead times and transfer of risk Areas, charges and lead times are set out in the Shipping Policy. Delivery to mainland France and the European Union; other destinations case by case on quotation. Under Article L.216-1 of the French Consumer Code, unless otherwise agreed, goods are delivered within a maximum of 30 days from the conclusion of the contract. In the event of failure, the Customer may, under Articles L.216-2 et seq., require delivery within a reasonable additional period, then terminate the contract and obtain a refund. Risk passes when the product is physically handed over to the Customer or to a third party designated by them.

Article 7 – Right of withdrawal (14 days) Under Articles L.221-18 et seq. of the French Consumer Code, a consumer Customer has 14 days from receipt to withdraw, without reason and without penalty. The Customer notifies their decision by an unambiguous statement (email to revpartsworks@gmail.com), using the model form below if they wish, then returns the product complete and in its original condition within 14 days. The direct cost of return is payable by the Customer. The Seller refunds all sums paid, including standard delivery charges, within 14 days at the latest of being informed of the withdrawal; the refund may be deferred until the goods are recovered or proof of dispatch is provided. The refund is made using the same payment method as the order.

Exceptions (Article L.221-28): the right of withdrawal does not apply, in particular, to goods made to the Customer's specifications or clearly personalised (custom-made parts).

Article 8 – Legal guarantees Independently of any commercial warranty, the Seller remains bound by: – the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code): the Customer has 2 years from delivery to act, may choose between repair and replacement (subject to the cost conditions set by law), and is not required to prove the existence of the defect during the 24 months following delivery; – the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may choose between rescinding the sale and a reduction in price, within 2 years of discovering the defect. Article 9 – Liability and use The products are accessories intended to be used for their intended purpose. The Seller cannot be held liable for incorrect fitting, improper use, exposure to conditions (temperature, mechanical stress) beyond those envisaged, or indirect loss. Save where fault is proven, the Seller's liability may not exceed the amount of the order concerned.

Article 10 – Personal data Data collected is processed in accordance with the Privacy Policy and the GDPR.

Article 11 – Consumer mediation In the event of a dispute, the Customer first contacts the Seller (revpartsworks@gmail.com) to seek an amicable solution. Failing that, under Articles L.612-1 et seq. of the French Consumer Code, the Customer may refer the matter free of charge to the mediator to which the Seller belongs: CM2C – 49 rue de Ponthieu, 75008 Paris, France – www.cm2c.net/declarer-un-litige.phplitiges@cm2c.net. The Customer may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr.

Article 12 – Governing law and jurisdiction These Terms are governed by French law. Failing an amicable settlement, disputes fall within the jurisdiction of the competent French courts, subject to the protective rules applicable to consumers.
